TERMS AND CONDITIONS:

We will not respond to inquiries or process orders when a time-limited email address is used. Online orders placed through a proxy may not be accepted. Orders placed with a non-verified email address or inoperable phone number may be declined without comment. Orders that originate outside the U.S. or Canada will be automatically declined unless prior arrangements have been made. We reserve the right to refuse or decline orders or service without comment solely based on our own discretion and judgment.

It is the marketer's responsibility to determine if leads are appropriate for the intended use, exercise due diligence and to be in compliance with any and all applicable regulations and laws when marketing using any type of sales lead and to make sure that all marketing or sales is performed in a manner that is in compliance with any and all statutes including adherence to no-call rules. We do not verify lead information unless noted otherwise.

Our service is provided as-is. Leads are sold as-is. Orders are non-refundable due to the fact that once information has been received; the value of the information is diminished. Therefore, all sales are final. In order to purchase and use leads we provide, customers must agree to hold the company, APS, business partners, and any principals or associates harmless.

We provide non-scrubbed phone numbers and email addresses geared for use by marketers who are familiar with how to perform proper list hygiene only. Lists and lists are provided without warranty or guarantee of any kind. Leads are not guaranteed or warranted regarding suitability of purpose. Since leads are not guaranteed to be suitable for a particular use or application or purpose and given the variables involved in the sales process and other factors which are outside of our care, custody and control, we do not guarantee that leads will achieve a particular result or response rate.

Should a customer attempt to process a chargeback, it will be contested in accordance with our sales policies. Any and all costs required to resolve a dispute or attempted chargeback or payment will be the sole responsibility of the cardholder given that we do not issue refunds due to the nature of the product. If any dispute results in a court action, the matter will be decided in Paulding County Ga which is the jurisdiction of the processing company which provides merchant services.

We will not be held liable for any damages that may arise from any transaction, the use or abuse of leads provided or not provided, failure to meet a schedule or any other system or website failure or unavailability of services. In any case, we will not pay out damages beyond the value of $.50 no matter what a court finding might be. If any part of the terms and conditions of sale or use are found to be invalid by a court or legal finding, this will not affect other terms and conditions or render any other element void.

If you do not agree to hold harmless you do not have permission to submit an order or use leads we provide. We do not provide recommendations as to how to conduct marketing or use leads as we only sell leads to knowledgeable and competant marketers who know how to market and adhere and comply with all rules and regulations that may apply to their activities. To purchase and use leads, you must promote a product or service that is legal, ethical and morally acceptable. It is the responsibility of the marketer who uses a lead to be incompliance with all terms and laws governing their actions or failure to take action. It is the sole responsibility of a customer and marketer to determine if leads are appropriate for their use.

Only written statements provided by a duly authorized representative who is an officer of our company will be considered relevant or applicable to any product or use of a product we may provide. We do process order information using a security certificate and take reasonable steps to avoid unintentional data access. However, we will not be responsibile or liable for any inadvertent sharing, deletion or loss of data, data breech or unauthorized access.

We make no warranties or guarantees regarding leads or services and none are expressed or implied. We can not and do not assume any responsibility for a customer or marketer who fails to exercise good judgment or who fails to comply with applicable rules or laws or regulations. It is suggested that you consult with a knowledgeable advisor before engaging in any marketing activity especially if you are not familiar with rules and current laws and regulations.

If leads are resold by a customer to another party, the reseller assumes any and all responsibility for the sale and any actions that may arise from the use or abuse of information or leads provided. We will not be the enforcer of this requirement or any other requirement in regard to responsibilities or duties assigned to a customer or marketer nor will we be held responsible for any action or inaction of a customer or marketer. Our failure to take action or respond to a violation of our terms of service does not in any way alter terms of service or render terms and conditions as inactive. If you do not agree with our terms and conditions, you do not have permission to purchase our lead products or use leads or information we provide. Service may change or be modified or discontinued without notice and terms and conditions may change without notice.

Please note that as part of an online order transaction, we may collect identifying information which will include a real IP address and other information that may be used to verify the identity of a customer. In addition, we do employ certain fraud-prevention measures to insure that we protect the interest of legitimate customers and credit card holders. Attempts to use credit cards that are not the property of the customer will be documented and we will work with law enforcement authorities to investigate and prosecute credit card fraud.

PRIVACY:

We will not share customer information other than provide information to our associates and business partners in conjunction with established business policy and information sharing agreements or unless required by a legitimate legal authority or court action.

We will never request personal information such as social security numbers or financial information such as account numbers or request that personal or financial information be provided by email. If you receive an email that is puportedly from FastTrackMLMLeads or APS that requests such information, please forward the email to us immediately and do not respond to the email or provide any information to the requestor.

We may utillize cookies and other means to collect non-personal information from site visitors and customers in order to be able to analyze traffic assist with processing orders and other site activities and to insure we provide service to legitimate customers. We may log all site visits and order activity in order to protect our service and the interest of legitimate credit card holders. Information will include but is not necessarily limited to IP address, date and time, and other relevant information.

We may contact customers with a low-volume newsletter or send promotional and sales information from time to time. If you do not wish to be contacted by email, we request notification by email. Please allow up to two weeks for your status to be changed.

Should a respondent wish to be removed from a contact list, please contact the marketer who contacted you and request removal. It is the marketer's responsibility to honor and process all opt-out requests.
